A key advantage of Mediation is that all discussions are considered confidential. This means that the points raised and considered in mediation cannot be used in other legal proceedings. There are some rare exceptions i.e., if the matter relates to abuse or may relate to the harm of someone.

The confidentiality of the discussions allows the clients to openly express their views.

The clients can share potential options for resolution of the conflict without concern that these options will be used against them if there are any further legal proceedings. This allows the clients to be fully open and transparent. They can share their innermost views without repercussions in future processes.

The clients must both agree to keep the conversations in Mediation confidential. They are not to share this information to any others outside the of Mediation meeting. This further supports the clients to express their views with the confidence that the views will not be shared with others.

The open sharing of views and opinions will allow the clients to better understand each of their views. Greater understanding will support the creation of solutions. Furthermore, this greater understanding will allow any agreements to be more successful and long-lasting, as the clients understand each other to a greater degree.

Mediation is an unbiased process. The Mediator does not take a position. The Mediator cannot show bias or judgment. The Mediation Process is a well researched and recognized method of resolving conflict in a non confrontational manner. The Mediation Process is to be as non adversarial as possible. The Mediator not taking sides, reducing the adversarial nature of the discussions. The Mediator is to follow the Mediation Process for positive outcomes.

Mediation is a conversation between clients where they can openly discuss their issues in a respectful meeting. The job of the Mediator is to follow the Mediation Process that promotes better understanding of the views of each client.

The Mediator, in being unbiased, does not create adversarial discussions. The discussions will not be a challenge to create opposing arguments and positions. Mediation promotes identifying common interests to then work towards solutions that will be mutually acceptable.

Since the Mediator does not take sides, is unbiased, the Mediator allows the clients to present their positions and views from their perspective. The clients can fully express themselves and describe their understanding of the issues, in their own words, without fear of judgement.

The Mediator will work to ensure that the conversations are peaceful and productive. The Mediator will focus on creating solutions for the future. The Mediator will not dwell on accusations by the clients, blame or past events.

Mediation allows the clients to reach their own solutions. The Mediator will not influence or judge the views or solutions. The clients know the situation better than anyone else. Their solutions will be more successful and long lasting as the clients have determined, based on their unique circumstances what they think is best for their futures.

Mediation is a process that will allow you to resolve your issues faster. Mediation involves discussions with you and the other individual. These meetings will be held at your convenience. You have the option to resolve your issues at your own pace.

Court processes involve delays. Legal proceedings can take months to schedule. With Mediation you and the Mediator determine the scheduling of the Mediation meetings. You can work toward resolution at your own pace.

Through Mediation you can reach decisions that are agreeable to you both. These agreements can be written up in a formal Agreement by the Mediator. You then can take this Agreement for your lawyer to review to ensure it meets all legal requirements. Your settlement can then be submitted to a Judge for approval.

Mediation is a process that focuses on the future. The Mediator will provide a peaceful respectful setting to address the needs of both of you for better futures. The past and previous grievances are not the focus. In this way you can reach a faster solution by working in a non adversarial setting to determine what will work best for you going forward.

A faster process to resolve issues will save you money. Most Mediators’ hourly rates are a fraction of a lawyer’s hourly rate. Through Mediation, you can collect the necessary information, discuss the issues and through these discussions reach mutual understanding of the matters. The review of the pieces of information and conversations can occur at a lower cost and a faster pace. You determine the pace of the Mediation process based on your ability to access and provide the documents.
